《政府采購法》規定供應商要以書麵形式提出質疑,但是對於質疑具體應當包括哪些內容卻未予以明確。根據《政府采購供應商投訴處理辦法》和相關法律規定,筆者認為供應商質疑的形式要件主要包括以下幾個方麵:一是按照政府采購法的規定,質疑必須以書麵形式提出。二是質疑須在法律規定的期限內提出。三是質疑須有具體的事項、事實依據和相關證明材料。四是質疑應當署名,質疑人為自然人的,應當由本人簽字;質疑人為法人或其他組織的,應當由法定代表人(主要負責人)簽字或項目授權代理人簽字並加蓋公章。隻有質疑符合以上形式要件,采購機構才能受理,否則應告知供應商修改後重新提出。
如何確定相關期限的起止時間
《政府采購法》規(gui)定(ding)供(gong)應(ying)商(shang)提(ti)出(chu)質(zhi)疑(yi)的(de)期(qi)限(xian)為(wei)知(zhi)道(dao)或(huo)應(ying)知(zhi)其(qi)權(quan)益(yi)受(shou)到(dao)損(sun)害(hai)之(zhi)日(ri)起(qi)七(qi)個(ge)工(gong)作(zuo)日(ri),采(cai)購(gou)機(ji)構(gou)答(da)複(fu)質(zhi)疑(yi)的(de)期(qi)限(xian)為(wei)收(shou)到(dao)書(shu)麵(mian)質(zhi)疑(yi)後(hou)七(qi)個(ge)工(gong)作(zuo)日(ri)。政(zheng)府(fu)采(cai)購(gou)法(fa)雖(sui)然(ran)規(gui)定(ding)了(le)質(zhi)疑(yi)提(ti)出(chu)和(he)答(da)複(fu)的(de)期(qi)限(xian),但(dan)是(shi)在(zai)具(ju)體(ti)適(shi)用(yong)過(guo)程(cheng)中(zhong)如(ru)何(he)計(ji)算(suan)期(qi)限(xian)的(de)起(qi)止(zhi)時(shi)間(jian)還(hai)需(xu)要(yao)進(jin)一(yi)步(bu)明(ming)確(que)。《民法通則》規定:“按照日、月、年nian計ji算suan期qi間jian的de,開kai始shi的de當dang天tian不bu算suan入ru,從cong下xia一yi天tian開kai始shi計ji算suan。期qi間jian的de最zui後hou一yi天tian是shi星xing期qi日ri或huo者zhe其qi他ta法fa定ding休xiu假jia日ri的de,以yi休xiu假jia日ri的de次ci日ri為wei期qi間jian的de最zui後hou一yi天tian。期qi間jian的de最zui後hou一yi天tian的de截jie止zhi時shi間jian為wei二er十shi四si點dian。有you業ye務wu時shi間jian的de,到dao停ting止zhi業ye務wu活huo動dong的de時shi間jian截jie止zhi。” 根據《民法通則》的de相xiang關guan規gui定ding,我wo們men可ke以yi明ming確que供gong應ying商shang提ti出chu質zhi疑yi期qi限xian的de起qi算suan點dian為wei知zhi道dao或huo應ying知zhi權quan益yi受shou到dao損sun害hai之zhi日ri的de第di二er天tian,期qi限xian的de截jie止zhi日ri如ru為wei法fa定ding休xiu假jia日ri的de,則ze以yi休xiu假jia日ri的de次ci日ri為wei最zui後hou一yi天tian,截jie止zhi時shi間jian為wei業ye務wu活huo動dong停ting止zhi時shi間jian。質zhi疑yi答da複fu的de期qi限xian起qi算suan點dian為wei收shou到dao書shu麵mian質zhi疑yi的de第di二er天tian,但dan是shi如ru果guo經jing審shen查zha質zhi疑yi不bu符fu合he要yao求qiu,告gao知zhi供gong應ying商shang修xiu改gai後hou重zhong新xin提ti出chu的de,以yi重zhong新xin提ti出chu質zhi疑yi並bing受shou理li之zhi日ri的de第di二er天tian為wei質zhi疑yi答da複fu的de起qi算suan點dian。質zhi疑yi答da複fu期qi限xian截jie止zhi日ri的de確que定ding與yu質zhi疑yi提ti出chu期qi限xian截jie止zhi日ri的de確que定ding方fang法fa相xiang同tong。
如何確定供應商質疑是否超出期限
《政府采購法》對供應商質疑處理借鑒了《民法通則》對於訴訟時效的規定。《民法通則》規定:“向人民法院請求保護民事權利的訴訟時效期間為二年,法律另有規定的除外” 、“訴訟時效期間從知道或者應當知道權利被侵害時起計算。”通過以上規定我們可以看出人民法院對民事權利的保護有時間上的限製,期間的起算點從知道或應當知道權利被侵害時起計算。《政府采購法》對(dui)供(gong)應(ying)商(shang)的(de)質(zhi)疑(yi)期(qi)限(xian)規(gui)定(ding)為(wei)七(qi)個(ge)工(gong)作(zuo)日(ri),超(chao)出(chu)期(qi)限(xian),采(cai)購(gou)機(ji)構(gou)可(ke)以(yi)不(bu)予(yu)受(shou)理(li)質(zhi)疑(yi)。在(zai)具(ju)體(ti)操(cao)作(zuo)時(shi),如(ru)何(he)確(que)定(ding)供(gong)應(ying)商(shang)質(zhi)疑(yi)期(qi)限(xian)的(de)起(qi)算(suan)點(dian)即(ji)如(ru)何(he)確(que)定(ding)供(gong)應(ying)商(shang)知(zhi)道(dao)或(huo)者(zhe)應(ying)知(zhi)其(qi)權(quan)益(yi)受(shou)到(dao)損(sun)害(hai)的(de)時(shi)間(jian)關(guan)係(xi)到(dao)認(ren)定(ding)供(gong)應(ying)商(shang)質(zhi)疑(yi)是(shi)否(fou)超(chao)期(qi)限(xian)和(he)采(cai)購(gou)機(ji)構(gou)是(shi)否(fou)受(shou)理(li)的(de)問(wen)題(ti)。根(gen)據(ju)《政府采購法》對供應商質疑的相關規定,在確定質疑期限起算點時可以分為以下三種情況區別對待:yishigongyingshangruguoduicaigouwenjiantiqizhiyi,quedingqizhiyideqishishijianyingweicaigouwenjianlingqushijian,yinweigongyingshanglingqulecaigouwenjianwomenjiukeyirendingqizhidaohuoyingzhicaigouwenjianneirongshifouduiqiquanyizaochenglesunhai。ershiduiyucaigouguochengtichuzhiyideshijian,yingjutiwentijutifenxi,yibanqingkuangxiayingrendingweicaigouguochengzhongmouyicaigouxingweitongguoxiangguantujingweigongyingshangsuozhideshijianweiqishishijian。sanshiduiyucaigoujieguotichuzhiyideshijian,yingrendingweicaigoujieguogongkaiduiwaixuanbudeshijian,caigoujieguoyijingxuanbu,gongyingshangjiukeyipanduanqiquanyishifoushoudaoqinhai。

質疑處理的各個環節均應采取書麵形式
采購機構應特別注意在質疑處理的各個環節均應采取書麵形式,留有書麵證據,避免供應商投訴時,無證可對。《政府采購法》規定質疑的提出和處理結果均須采取書麵形式。財政部2007年新出台的《財政部關於加強政府采購供應商投訴受理審查工作的通知》中,第二個問題專門規定“不予受理的投訴要書麵告知”,cankaocaizhengbuduigongyingshangtousudezuofa,caigoujigouzaibuyushoulizhiyishiyeyingcaiqushumianxingshigaozhi。chuleyishangguidingwai,bizherenweiyixiagehuanjiezhongjunyingcaiqushumianxingshi。yishizhuanmenfuzezhiyichuliderenyuanyingshezhizhiyichulidengjibo,baokuoxiangmumingcheng、項目編號、項目部室、質疑供應商、質疑時間、質疑內容、答da複fu時shi間jian等deng內nei容rong,方fang便bian查zha詢xun和he掌zhang握wo質zhi疑yi處chu理li的de整zheng個ge過guo程cheng,為wei事shi後hou應ying對dui供gong應ying商shang投tou訴su做zuo好hao準zhun備bei工gong作zuo。二er是shi供gong應ying商shang當dang場chang送song達da質zhi疑yi時shi,應ying出chu具ju統tong一yi格ge式shi的de質zhi疑yi簽qian收shou證zheng明ming;郵寄送達時應保存信封或特快專遞信息聯等有效證明。三是質疑答複書當場送達時,應出具統一格式的質疑答複書簽收證明;郵寄送達時,應采取掛號信或特快專遞等能夠留有書麵郵寄證明的方式寄出,並保存相關的郵寄證明。
